Terms of Use

1. MY SONY REWARDS MEMBERSHIP (THE "SERVICE")

1. The Service provides a variety of applications and services to its members ("My Sony Rewards members").
2. The Service is offered to you under the following terms and conditions, along with any amendments thereto, and any operating rules or policies as prescribed by individual applications or such rules that may be published from time to time by Sony (Malaysia) Sdn Bhd. (hereinafter referred to as "Sony MY" or "Sony") or any of its affiliates and/or subsidiary (hereinafter referred to as "Terms of Use"). Please read them carefully.
3. By completing the registration process, you are stating that you are at least 18 years of age or 15 years of age with parental consent to use this service, that you are eligible to use the Service, and that you agree to be bound by all of the terms and conditions of these Terms of Use. Sony MY may in its sole discretion revise these Terms of Use at any time without notice to you by updating this posting, and you are advised to visit this page periodically to review the Terms of Use, since they are binding on you. Violation of any of these Terms of Use may result in the cancellation of your registration with or without notice or termination of your access to the Web Site, as well as legal action against you.
   
   PARENTS: Parents are recommended to accompany your children when using the Service.
4. The Service is strictly country and area specific and the Web Site (defined below) is targeted at users resident in Malaysia.
5. Members should be individual persons and not corporate entities. One membership is allowed per person. Your membership will be effective when your online registration is accepted and communicated to you via email acknowledging the new membership. You will receive a membership user ID and password that may be used by you for all your transactions on the Web Site.
6. Use of your membership user ID is expressly limited to you and you may not transfer your membership to any other party, whether temporarily or permanently. You agree to bear sole responsibility for all use of your membership and for the confidentiality of your password. Sony will suspend access or change access to your account upon notification by you through e-mail to Sony that your password has been lost, stolen or otherwise compromised.
7. Only registered My Sony Rewards members may access the services on the Web Site. You shall ensure that your membership user ID and password are kept in a secure and confidential manner, and you must not permit its release to third parties. You are solely responsible for maintaining the confidentiality of your membership user ID and password.
8. If, at any time, you are no longer a user resident in Malaysia, please inform Sony promptly by contacting us through our website at https://web.sony-asia.com/my/contact-us/. Sony will reply to you with details of how your My Sony Membership may be affected or terminated by Sony.
9. You hereby agree to:-
   1. be solely responsible for and take all such measures and steps to maintain and protect the confidentiality of your password (including but not limited to changing your password from time to time);
   2. take all such measures and steps to prevent any unauthorised use of your membership user ID;
   3. taking all such measures and steps to prevent publication of your password;
   4. be solely responsible for any and all activities which occur and/or any and all messages, information and other materials furnished, created and/or posted under your membership user ID;
   5. immediately notify Sony if you become aware of or have reason to believe that there is any unauthorised use of your membership user ID or any other breach of security, to co-operate with Sony in all such security investigations and to indemnify, defend and hold harmless Sony for any liability or expense arising from such use or misuse.
10. You are responsible for any and all activities and transactions performed through your membership user ID on the Web Site. Any transaction or use of the Web Site under your membership user ID which is authenticated by your password shall be deemed to be on your behalf or as your agent, with due authorization from you at all times. Any transaction made on the Web Site using any of your membership user ID and password and through your membership user ID shall be deemed to be binding on you. Use of the Web Site by any unauthorized personnel is prohibited. You shall notify Sony immediately of any unauthorized use of any user identification, passwords or other security information, or breach of security. Sony cannot and will not be liable for any loss or damage arising from your failure to comply with this requirement.
11. You shall acquire no rights to your membership user ID or password selected by you or assigned to you by Sony and Sony reserves the right to change the same as its sole discretion without being liable to you for any loss or damage of any nature whatsoever (whether direct, indirect, incidental, punitive, exemplary or consequential) suffered.
12. Notwithstanding the foregoing, you acknowledge and agree that any contracts in relation to the purchase of Products from any third party by you arising out of or in connection with your use of the Site are between such third party and you, and that insofar as Sony is involved in any such contract, Sony is acting only as an agent or contractor of that third party. You acknowledge and agree that in all circumstances your only recourse in respect of any such contract shall be against that third party, and that you shall not under any circumstances have any recourse against Sony.
13. Sony may terminate your membership or take any other action it deems in its sole and absolute discretion necessary and/or appropriate, if it believes, in its sole and absolute discretion, that you have violated any of these My Sony Membership Terms of use.
14. In the event of termination of your membership for any reason, you will remain obligated not to violate the rights of any person or entity with respect to any materials you may have downloaded from the Web Site.

2. USER REGISTRATION, PASSWORD AND SECURITY

To use our Service, you must complete a registration form. You will select a password upon registration. At the time of registration and at various times when using any homepage under the name of Sony MY and/or Sony (hereinafter referred to as "Web Site"), you will be asked to provide Sony MY with personally identifiable information including, without limitation, your name, date of birth, gender, contact information, e-mail address, credit card details ("Information"). You must ensure that the Information you provide is accurate, true, current and complete. If this is not the case or Sony MY has reasonable grounds to suspect as such, Sony MY has the right to cancel your registration.

You are required to provide information about yourself for registration or otherwise which is complete and accurate. You may update the information online from time to time. You must promptly inform Sony of any: (1) changes in your home address; (2) breaches of security, including loss, theft, or unauthorised disclosure or use of your membership user ID or password; or (3) changes in your e-mail address. Until Sony receives notice of a breach of security, you will remain liable for any unauthorised use charged to your membership user ID.

You understand that any and all Information you provide us will be collected and may be used for the purposes of collecting data for identity ratification and records, sending you information about different products and services, maintaining contact lists for correspondence, compiling aggregate statistics on Web Site usage, processing your purchase orders and rendering services such as warranty and after sales services. For the above purposes Sony MY may share your Information with associated companies in the Sony group either in Malaysia or overseas. To enable us to provide you with customised and personalised services, we use cookie files to store and track information about you when you visit the Web Site and this is done without you being aware that it is occurring. You acknowledge and agree that you are solely responsible for the form, content and accuracy of any material or the Information placed by you on the Web Site.

3. MEMBER PRIVACY / SONY MY'S PRIVACY POLICY STATEMENT

It is Sony MY's policy to respect the privacy of its users. You are aware that any Information supplied by you will be retained by Sony MY and will be accessible to the Sony MY's employees (including any employees of any holding, subsidiary or associated companies) and other persons or bodies corporate engaged by Sony MY for or in relation to any of the purposes listed above or to third parties as stated in the Sony MY's Privacy Policy which may be accessed at https://www.sony-asia.com/microsite/privacypolicy/my.

4. MY SONY REWARDS PROGRAM

• 4.1. General
  • 4.1.1 By completing the registration process for the Service, you will automatically be a member of the loyalty programme named "My Sony Rewards Program" operated by the Sony MY and/or its affiliates ("Rewards Programme", or as the context requires, the "Programme").
  • 4.1.2 Upon a successful registration, you shall automatically be accorded with "My Sony Rewards Program Member" status and may commence accumulating Sony points ("Points") from qualifying transactions under the Programme. The Programme membership is non-transferable and shall be for personal use of the registered user only.
  • 4.1.3 The Programme shall only be valid within Malaysia ("Territory").
• 4.2. Benefits
  • 4.2.1 As a member of the Programme, you will gain access to the e-vouchers, promotions, discounts, free gifts, promotion codes and other benefits offered by Sony MY and/or third-party merchants as shown on the rewards catalogue in the member portal ("Rewards"). Sony MY may, at its sole and absolute discretion, award you Points which can be used to redeem for Rewards upon the completion of the qualifying transactions. You may earn points by such methods as are provided for by the Sony MY from time to time. Further, Sony MY makes no representation or warranty with respect to any products and/or services featured in the Rewards. Without prejudice to the generality of the foregoing, Sony MY makes no warranty with respect to the quality of the Rewards or their suitability for any purpose.
• 4.3. Platinum Exclusive Enhanced Repair Services
  Platinum Exclusive Enhanced Repair Services are only eligible for products registered in My Sony, not applicable for PlayStation products
  • 4.3.1 Nationwide Priority Repair Service
    The Member ("You") shall be entitled to priority repair support with a committed turnaround time of seven (7) business days at participating Sony Authorized Service Centres nationwide, subject to the following conditions: (i) parts availability; (ii) service capacity; and (iii) other terms and conditions as may be imposed by Sony from time to time. Sony reserves the right to extend the aforementioned turnaround time in the event of unforeseen circumstances beyond its reasonable control.
  • 4.3.2 Loan Unit During Repairs
    Subject to availability and solely at Sony's discretion, Members residing within the Klang Valley region may be provided with a loan unit while their product is undergoing repair. Such loan units shall be: (i) allocated on a first-come, first-served basis; (ii) limited to Digital Imaging, TV & Xperia products only; and (iii) must be returned in good working condition, free from damage, upon completion of the repair service. Sony reserves the right to impose charges to the Member for any damage, loss, or failure to return the loan unit within three (3) business days of notification of repair completion.
  • 4.3.3 Complimentary Camera and Lens Cleaning
    Members shall be entitled to two (2) times complimentary camera or lens cleaning services per calendar year per unit, subject to the following limitations: (i) services are available exclusively in Johor, Penang, Klang Valley regions, Kuching and Kota Kinabalu at designated Sony Authorized Service Centres; (ii) service provision is subject to availability; and (iii) Sony reserves the right to refuse service if, in its sole judgment, the lens condition requires additional repair beyond standard cleaning procedures.
  • 4.3.4 Complimentary Home Delivery of Repaired Product
    Upon completion of repair services, Members residing within the Klang Valley region shall be entitled to complimentary home delivery of bilateral serviced product. Such delivery shall be subject to: (i) standard logistics arrangements; (ii) service coverage limitations; and (iii) delivery scheduling at Sony's convenience. Sony shall not be liable for any delay in delivery resulting from circumstances beyond its reasonable control.
  • 4.3.5 10% Discount on Out-of-Warranty Repairs
    Platinum Members shall receive a ten percent (10%) discount on repair charges for all products that are no longer covered under warranty. Said discount shall apply exclusively to Sony-authorized parts and labor charges. This discount cannot be combined with any other promotion, offer, discount, or SEW repair and excludes any third-party components or services that may be required for complete repair.
• 4.4. Loyalty Points /e-vouchers
  • 4.4.1 The Company may, at its sole and absolute discretion, increase or decrease the rate of Points to be awarded for each selected transaction as may be notified to you from time to time. You shall not be entitled to request from the Company any explanation pertaining to the calculation methods (for crediting the Points) or other matters relating to the Points or discounts for whatsoever purposes.
  • 4.4.2 Sony MY reserves the right to hold the issuance of Point earned until the products are delivered or collected in-store.
  • 4.4.3 Points accumulated by the Member shall be valid for two (2) years and will expire thereafter. In such an event, the expired Points shall be automatically removed without notice to the Member.
  • 4.4.4 You must use your Points earned to redeem for Rewards during their applicable validity period. There shall be no extension of time for the validity period of any unused Points. Sony MY shall have the right to deal with the expired Points in such manner as it deems fit in its absolute discretion. You agree that you will have no claim whatsoever against the Sony MY for any expired Points.
  • 4.4.5 In the case of refunds, returns and product exchanges, the corresponding Points earned or e-vouchers redeemed will be voided accordingly. If the Points that you have redeemed: (i) for purchases of Sony products; and/or (ii) for Reward(s) and such Reward(s) were successfully used by you ("Used Points"), the money to be refunded to you in this case shall be deducted with an amount equivalent to the Used Points in case that your Points balance has no Points left to offset with Used Points.
  • 4.4.6 Points or e-vouchers have no cash or monetary value and are not redeemable for cash in any form. They cannot be purchased, resold or transferred, for value or otherwise, under any circumstances. Points shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances.
  • 4.4.7 Points that you have successfully redeemed for a Reward cannot be exchangeable for another Reward under any circumstances. No requests for exchange or refund of Rewards will be entertained.
  • 4.4.8 You may check your Points balance and redemptions made in the member portal. Your Points balance and redemptions as set out in the member portal shall serve as conclusive evidence of the same.
  • 4.4.9 Sony MY does not accept any liability whatsoever with respect to Rewards supplied or in connection with any refusal by supplier of Rewards to accept e-vouchers issued for the purpose of redeeming such Rewards. Any dispute arising from or in connection with such certificates/ e-vouchers shall be solely between the Member and such suppliers.
  • 4.4.10 Rewards in the form of certificates/e-vouchers are valid for use subject to the expiry date specified on the said certificates/e-vouchers. All unused certificates/e-vouchers shall after the expiry date be deemed null and void and shall not be replaced by Sony MY. The use of the certificates/e-vouchers are subject to the terms and conditions contained therein and are valid for use only at such participating establishments as are stated thereon.
• 4.5. Ways to Earn Points
  • 4.5.1 Members can earn Points by spending in Sony Stores (Physical) and Sony Store Online in Malaysia.
  • 4.5.2 Sony Marketplaces such as Lazada, Shopee and other sales channels are not eligible for points earning. Sony products purchased outside of Malaysia are not eligible to earn Points.
  • 4.5.3 PlayStation® Products and Non-Sony products are exempted from Points earning. Product exclusions will be updated from time to time.
  • 4.5.4 Points are awarded based on the net amount after all discounts and/or e-voucher values have been deducted. Discounts and/or Sony e-vouchers are not eligible for point earning when used in transactions. Points are awarded on a "per item" basis, rounded down to the nearest whole number.
  • 4.5.5 Points are awarded based on the Member's Tier as follows:

  • 4.5.6 Points can also be earned by participating in non-purchase activities which Sony may carry out from time to time.
    • 4.5.6.1 Profile Completion Bonus
      • Members who complete all the mandatory fields on their membership profile page and opt-in to receive marketing communications will also receive a one-time profile completion Points.
      • Members who remove and then re-add the required fields will not receive the bonus points again.
      • Points awarded upon successful completion of profile update and points for profile completion will be limited to one time per member's lifetime.
    • 4.5.6.2 Survey Completion Bonus
      • Members who complete an eligible survey sent to the email address they used to sign up for My Sony Rewards membership will earn Points.
      • Points will be awarded upon confirmation of survey completion.
      • Members will only receive a one-time survey completion bonus, even if they submit their response multiple times.
• 4.6. Ways to Redeem Points /e-vouchers
  • 4.6.1 Points can be redeemed for discounts for purchases in Sony Stores (Physical) and Sony Store Online in Malaysia, or redeemed for 3rd party e-vouchers from My Sony Rewards portal.
  • 4.6.2 Points which are used for discounts are limited to Sony Stores in Malaysia (Online / Physical) excluding Sony Marketplaces (eg Lazada or Shopee) and other sales channels.
  • 4.6.3 PlayStation® Products and third party products are exempted from Points redemptions. Product exclusions will be updated from time to time.
  • 4.6.4 If you comply with all these Terms of Use and have the required number of Points, you may select and redeem applicable Rewards via the member portal. Your redemption of a Reward that is an e-voucher is subject to the additional terms and conditions of the Sony MY or the third-party merchant (as the case may be) that offers the particular e-voucher that you wish to redeem.
  • 4.6.5 You must use your e-vouchers redeemed during their applicable validity period. There shall be no extension of time for the validity period of any e-voucher redemption dates. You agree that you will have no claim whatsoever against the Sony MY for any expired e-vouchers.
  • 4.6.6 Rewards are not redeemable for cash nor are they exchangeable or refundable for other Rewards under any circumstances. They cannot be resold, exchanged, refunded or transferred for value under any circumstances. Rewards shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances.
  • 4.6.7 Sony MY may at its sole and absolute discretion and without prior notice to you, reject your request to redeem Points for any reason whatsoever, including without limitation, where:
    • 4.6.7.1 There are insufficient Points to redeem for the particular Reward;
    • 4.6.7.2 The Reward is no longer made available or out-of-stock by the third party merchant;
    • 4.6.7.3 The Points you wish to use for redemption of Rewards have been issued to you in error; or
    • 4.6.7.4 Sony MY reasonably believes that that redemption transaction may be suspicious, illegal, involves any criminal activity or involves points that have been obtained through dishonest or fraudulent means or abusive behaviour.
  • 4.6.8 All Rewards are subject to availability and Sony MY has the right to substitute the requested Rewards with other items of similar value in the event the requested Reward is out of stock or unavailable for whatever reason.
• 4.7. Membership Tiers
  • 4.7.1 The Programme offers three (3) membership tiers as follows:
    • 4.7.1.1 a basic membership tier known as "Club";
    • 4.7.1.2 a mid-level membership tier known as "Elite"; and
    • 4.7.1.3 a premier membership tier known as "Platinum".
  • 4.7.2 A tier cycle begins when a member joins the loyalty program and lasts for 24 months unless the current tier is upgraded. When a Member gets an upgrade, the new tier cycle is extended by 24 months. Tier expiry will end after 24 months from the date of upgrade.
  • 4.7.3 Points requirements are set out below:

  • 4.7.4 Certain Points earned under the Programme shall be designated as "Qualifying Points". Such Qualifying Points shall exclude Points issued by designated marketing campaigns, refunds, appeasements and such other events to be determined by Sony MY in its sole discretion. Qualifying Points calculated based on the net amount paid in the relevant transaction, net of all discounts and/or e-voucher values.
  • 4.7.5 Upon expiration of your membership tenure in a particular tier and if you have not earned sufficient Qualifying Points during the 24 months' tier cycle to be retained in that tier, you shall be downgraded to the next relevant membership tier.
• 4.8. Miscellaneous
  • 4.8.1 To the extent as permitted by applicable laws, the Company reserves the right at any time to:
    • 4.8.1.1 vary, modify or amend the terms and conditions of the Programme (including adding or deleting any terms);
    • 4.8.1.2 terminate or modify the Programme;
    • 4.8.1.3 revoke, adjust and/or recalculate any Points awarded;
    • 4.8.1.4 change the number of Points required for redemption of specific Rewards or substitute any Reward with another of a similar value;
    • 4.8.1.5 change the number of Points that can be earned on spendings on qualifying transportation services;
    • 4.8.1.6 modify the qualifications and eligibility for earning Points;
    • 4.8.1.6 modify the activities that earn Points;
    • 4.8.1.8 modify the methods used to calculate the number of Points to be awarded;
    • 4.8.1.9 withhold or cease the awarding of Points to you;
    • 4.8.1.10 modify the qualifying Points or other criteria for membership tier upgrades and renewals; and
    • 4.8.1.11 change or withdraw any benefits related to a particular membership tier; and/or
    • 4.8.1.12 change the duration taken for Points to expire.
  • 4.8.2 Without prior notice to you and at its sole discretion, the Company may suspend the calculation and accrual of Points to rectify any errors in calculation or adjust the calculation as it reasonably deems fit without giving you prior notice or reason.
  • 4.8.3 You shall be responsible for any taxes, levies or duties that arise in connection with the issuance of Points to you, your redemption of Points and/or the utilization of Rewards you have redeemed and all costs and expenses relating to the same shall be borne by you.

5. AUTO PRODUCT REGISTRATION

• 5.1 Auto Product Registration is a product warranty registration service for My Sony Rewards Members. You agree to consent to the processing of your personal information to process the product and warranty registration, including such warranty record in your My Sony Member account.
• 5.2 If you purchase the product through Sony Store Online (Malaysia), from Sony Stores in Malaysia, or from other authorised retailers while using a voucher/promotion/code you received from/through My Sony Rewards, your product will be automatically registered for a warranty. The Extended Warranty as set out in the table below will also apply to product warranty registration made under Auto Product Registration service.

• 5.3 The Auto Product Registration service does not apply to PlayStation® products or the products which have no warranty as stated in the support webpage. No partial product registration is allowed. No partial product registration is allowed.
• 5.4 We will take up to 8 days after the date of delivery to process the registration, after which your warranty for the relevant product will be reflected in your My Sony Rewards account.
• 5.5 Please refer here for the warranty terms and conditions and product warranty period information.

6. USE OF SITE

• 6.1 You also agree to abide by and comply with a separate set of terms and conditions in respect of any purchase of Products by you arising out of or in connection with your use of the Web Site, which are set out at https://www.sony.com.my/microsite/termsofuse.
• 6.2 Information and materials which you find published on the Web Site may be the property of Sony or others, and may be protected by and/or contain various intellectual property rights, including without limitation copyrights and trademarks. You may not copy, redistribute or commercially exploit such materials without the express written permission of the owner(s) of such information or materials.
• 6.3 You warrant that all materials you submit for publication or posting on the Web Site will not violate or infringe any copyright, trademark, patent, design right or other statutory, common law or proprietary rights of others, or contain anything obscene or libelous. By submitting information or materials owned by you for publication or posting on, or distribution through, the Site, you will be deemed to have granted Sony non-exclusive permission to redistribute by transmission the information or materials worldwide without charge or liability. Sony reserves the right, in its sole and absolute discretion, but is under no obligation, to refuse to post, delete or edit any information that you submit or enter into the Web Site. You agree that you will not hold, nor seek to hold, Sony liable for the loss of data or the misappropriation or infringement of any intellectual property right to which you claim ownership. You agree that Sony is the owner of any and all rights and interests (including without limitation copyrights) in the Web Site.
• 6.4 You acknowledge that from the Web Site you can access World Wide Web content that might contain illegal or offensive materials. You acknowledge that Sony is not liable for any World Wide Web content, other than that which it or its authorised agents or contractors directly author.
• 6.5 You acknowledge that Sony has the right to delete any of your files on the Web Site, at its sole and absolute discretion.
• 6.6 All areas and portions of the Site are considered public and, as such, there is no expectation of privacy or confidentiality. Sony reserves the right to maintain, and make use of, chat logs, and any other means that it deems in its sole and absolute discretion necessary and/or appropriate, to ensure that subscribers to the Web Site are complying with the rules of online behaviour above.
• 6.7 Sony makes no warranties on the future availability of any content on the Web Site. It reserves the right to modify or discontinue any content on the Web Site at any time, for any reason, without any advance notice.

7. TERMINATION

• 7.1 Any misuse of the Service may cause termination of your account. Sony MY reserves the right to delete all data in your account and bar any further access to such files, with or without cause at any time, for any reason or no reason, and/or to terminate your account and your use of the Service with or without cause at any time and effective immediately, without prior notice.
• 7.2 If you do not wish to be a member of the Programme or would like to terminate your membership or account, you may do so by contacting us through our webpage at https://web.sony-asia.com/my/contact-us/.
• 7.3 Upon your cessation as a member of the Programme, all then outstanding Points at such point in time shall be automatically voided. Once voided, Points cannot be redeemed or reinstated. No accumulation or carry over of Points will be permitted even if you subsequently reinstate your membership, such reinstatement to be at Sony's discretion.
• 7.4 Fraud, abuse of redemptions or any dishonest activities related to the Programme may result in the forfeiture of accumulated Points as well as, demotion of your membership tier, cancellation of your membership in the Programme or termination of your account.

8. NO SPAM

Sony MY will immediately terminate any account that it believes, in its sole discretion, is transmitting or is otherwise connected with any junk mail, spam, chain letters, or other unsolicited bulk e-mail commercial or otherwise.

9. NO RESALE OF SERVICE

You agree not to resell the Service or use of or access of the Service.

10. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Sony MY and its parents, subsidiaries, affiliates, officers, and employees from any loss, liability, claim, demand, damage, or expenses (including reasonable attorney's fees) asserted by any third party due to or arising from or in connection with your use of or conduct on the Service, or messages posted or transmitted by you on or through the Service or reserves the right, at its own expenses, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, which shall not excuse your indemnity obligations.

11. MODIFICATIONS TO TERMS OF USE OR TO THE SERVICE

Sony MY reserves the right to change the Terms of Use at any time without notice. Sony MY also reserves the right to modify or discontinue the Service, temporarily or permanently, with or without notice to you. You agree that Sony MY shall not be liable to you or any third party for any modification to or discontinuance of the Service.

12. SONY MY PROPRIETARY RIGHTS

14. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall Sony MY be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the Service, from the cost of procurement of substitute goods and services, from any goods or services purchased or obtained or messages received or transactions entered into through or from the Service or from unauthorized access to or alteration of your transmissions or data, including but not limited to damages for loss of profits, use, data or other intangibles, even if Sony MY has been advised of the possibility of such damages.

You further agree that Sony MY shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct, indirect, incidental, special, consequential or exemplary damages, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent.

Some jurisdictions do not allow the limitation of exclusion of certain warranties, conditions, and/or liability for some types of damages, so some of the above exclusions may not apply to you.

15. MISCELLANEOUS

The failure of Sony MY to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid or contrary to law, then such provision(s) shall be constituted, as nearly as possible, to reflect the parties' intentions, and the other provisions of the Terms of Use shall remain in full force and effect.

You agree that regardless of any statute or laws to the contrary, any claim or cause of action arising out of or related to use of the Service or to the Terms of Use must be commenced within one (1) year after such claim or cause of action arose or be forever barred.

The section titles in the Terms of Use are for convenience only and have no legal or contractual effect or significance.

16. FURTHER RULES

Each individual game or service of the Service may contain other laws/regulations on top of the above rules and you are required to go through it before you participate in such service.

17. JURISDICTION

These Terms of Use are governed by the laws of Malaysia and any dispute or difference arising out of or in connection to this Agreement or the breach thereof including any question regarding its existence, validity or termination, the parties hereto shall use their best endeavours to settle such disputes or differences through amicable discussions. To this effect, they shall consult and negotiate with each other, in good faith and understanding of their mutual interests, to reach an equitable solution satisfactory to both parties. If the parties are unable to reach any solution within a period of thirty (30) days after the commencement of the negotiation or thirty (30) days from the date upon which one of the parties shall issue a notice for submission of the matter for arbitration pursuant to this Clause, whichever is the later, then the disputes or differences shall be referred to and finally resolved by arbitration in Malaysia in accordance with the Arbitration Rules of the Asian International Arbitration Centre ("AIAC Rules") for the time being in force which rules are deemed to be incorporated by reference into this term.
