'What's Your View' Contest Terms & Conditions

Sony South East Asia (A division company of Sony Electronics (S) Pte Ltd) ("Sony") maintains this Facebook application ("App") and is responsible for this “What’s Your View” contest (“Contest”).

You can access and use this App only if you agree to and accept the following terms and conditions applying to your use ("Terms and Conditions") without limitation or reservation. Please read these Terms and Conditions carefully before accessing this App. You may download material displayed on the App for your non-commercial, personal use only. Additionally, you may not modify, reuse, report, or use the contents of the App for public or commercial purposes, including the text, images, audio, and video without Sony's written permission.

Sony reserves the right to cancel or amend the Contest mentioned on the App or these Terms and Conditions at any time without prior notice. Any changes will be posted either within the App or these Terms and Conditions.

Qualifying Entrants

1. The Contest is open only to residents of Singapore, Malaysia, Thailand, Vietnam, Indonesia and Philippines who are 18 years or older as at the date of participation. You warrant to indemnify Sony against any and all claims in relation to your participation of this Contest and breach of its Terms and Conditions contained herein. Sony’s rights are reserved.
   
   
2. Employees of Sony, their advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible.
   
   
3. Contest Rules:
   
   

   3.1.1. Access the Contest App via Sony - Power of Imaging Southeast Asia Facebook page (http://www.facebook.com/Sony.ImagingSEA) or http://whatsyourview.sony-asia.com.

   3.1.2. Submit photos during the challenge period via the App based on the given challenge theme as follows:

   Challenge/Theme	Period
   Challenge 1: Colours of Life	2nd – 28th December 2014 (11.59pm) (GMT +8:00)
   Challenge 2: Action	2nd January 2015 (12pm) – 1st February 2015 (11.59pm) (GMT +8:00)

   3.1.3 Each participant will be able to submit (5) five different photos only once per challenge (participants will be required to register prior to submitting their photos).

   3.1.4 All photos submitted are required to be in JPEG format. Each photo submitted shall be no less than 800kb in size and the total file size of all photos per challenge shall be no more than 10MB in total.

   3.1.5 Participants are personally responsible to ensure that submitted entries are successfully uploaded.  Any technical errors that result in failure to submit the entries within the stipulated timelines will render a disqualification.

   3.1.6. Participants of winning photos are required to submit their original photos with EXIF details intact.

   3.1.7 A panel of judges (appointed by Sony) together with a representative from Sony will then select a total of 12 winners (6 per challenge). The panel of judges and Sony will select 1 winner from each country for each challenge (i.e. 1 each for Singapore, Malaysia, Thailand, Indonesia, Philippines and Vietnam). The winning photos will be chosen based on the most creative photo submissions which are relevant to the theme of each challenge.

   3.1.8 Sony shall select a grand prize winner from the 12 winners.
   

4. Participant guarantees that the photo he/she is submitting is original and has not been previously published, for which the participant owns all necessary rights thereof. 
   
   
5. Participant confirms that each person depicted (if any) in the photo submitted has granted permission to be portrayed as shown. Any costumes, props or other materials used must be rented or borrowed with the permission of the owner, and all other relevant permissions must have been obtained.
   
   
6. Participant agrees to fully indemnify Sony in respect of all royalties, fees and any other monies owing to any person by reason of your breaching any of the foregoing.
   
   
7. Photos that are modified with any image editing software or equivalent programs are accepted. Participant guarantees that photo enhancement was made via use of legally acquired software.

Competition Entries

1. The above Contest is valid from 2nd December 2014 – 1st February 2015 (11.59am) (GMT +8:00)
   
   
2. By submitting the Contest entries, each participant thereby (a) specifically authorizes Sony to use and/or license third parties to use such entry in whole or in part, throughout the universe, in perpetuity in or on any and all media, now known or hereafter devised, and alone or together or as part of otherwise unlawful information, infringe or violate any copyright or other right, or contain any matter other information, content and/or material of any kind or nature; (b) represents and warrants that all elements contained in the Contest entry (i) is original to the participant or fully cleared for use as contemplated herein, (ii) does and will not, in any way, violate or breach any of the terms of any other agreement the participant may be a party to, (iii) does not contain libelous, tortuous, or the publication or sale of which will violate any federal or state statute or regulation, (iv) is not obscene or in any other manner unlawful, and (v) shall not require Sony to pay or incur any sums to any person or entity as a result of Sony's use or exploitation of the same.
   
   
3. Winners shall agree to be contacted by Sony or its authorized PR representatives to participate in public relations events tied to the campaign to generate press coverage of the Contest and the accessories range. This may include, but not be limited to, quotes given for inclusion in press releases and press conferences, interviews, etc.
   
   
4. Sony reserves the right to disqualify all entries that do not meet the rules and regulations of these Contests. These include entries submitted with invalid or incorrect information.
   
   
5. Unfair or unethical methods of participation may result in disqualification.
   
   
6. Sony’s decision for all winners is final.

Prizes

1. Prizes are non-transferable and non-exchangeable for cash and may be subject to availability. Value of the prizes may vary; Sony reserves the right to replace any prizes with items of similar value without prior notice.
   
   
2. Acceptance of any prize shall constitute consent on the winner's part to allow the use of the winner's name, image, voice and/or likeness by Sony for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law. Acceptance of any prize shall constitute a release and discharge of Sony by each winner from any and all liability, claims, demands, causes of action, and/or damages which the winner may have, whether known or unknown at the present time, of any nature whatsoever, arising out of or relating to: (i) the Contest, (ii) personal injury and/or property damage, theft or loss suffered by the winner as a result of the use and/or enjoyment of the prize, and/or (iii) any tax liabilities in relation to the Contest, prize and/or use or enjoyment of the same.
   
   
3. Results of all winners will be announced on the following dates via the App gallery :
   
   

   Challenge 1	3rd January 2015
   Challenge 2	7th February 2015
   Grand Prize	11th February 2015

   
   
4. The winners will also be notified separately by email or telephone and will be required to acknowledge by return email no later than 7 days after the notification was sent. Sony reserves the right to deal with all unclaimed prizes in any manner deemed fit. Winners will receive an additional letter including a form that must be filled out, signed and returned by the date stated therein. Should this not be signed and received by Sony (or its representative) by the requested date, winning status may be revoked.
   
   
5. Subject to the terms and conditions herein, there will be a total of (12) twelve winners for the Contest, (2) two winners in total per country and (1) Grand prize winner. The winners shall receive only the corresponding below listed prize(s) for the respective part of the Contest:
   
   

   Challenge 1	α5100 Single Lens Kit (each winner)
   Challenge 2	α6000 Single Lens Kit (each winner)
   Grand Prize	USD3,000 travel voucher

   
   
6. In the event that any winner is disqualified from the Contest, Sony, at its sole discretion, may decide whether a replacement winner should be selected. In this event, any further winner will be selected on the same criteria as set out in the Terms and Conditions. Sony can repeat this process any number of times until it has selected a satisfactory winner in accordance with these Terms and Conditions.
   
   
7. Where applicable, prizes not collected within 4 weeks from the date of notification for collection shall be disposed of at Sony’s sole discretion. Sony’s decision regarding the award of all prizes, and/or in every situation including any not covered in these Terms and Conditions, shall be final and binding on all participants in the Contest, and no queries, challenges or appeals may be made or entertained regarding Sony’s decision on the same. The receipt by any winner of any prize under this Contest is conditional upon compliance with any and all applicable laws, rules and regulations.
   
   
8. Sony reserves the right to amend/change the prizes without any liability to the participants.

Liabilities

1. Sony cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Contest or as a result of entering the Contest or accepting any prize. Sony is not responsible for any safe custody, return, non-delivery or missing of entries, late, misdirected, problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any app, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Contest.
   
   
2. By entering the Contest or accepting the prizes, You agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against Sony, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from the Contest and acceptance of any prize, including without limitation, personal injuries, death and property damage.
   
   
3. By submitting the Contest entries, you agree and warrant that you shall not submit any content (a) that is hateful, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence; (b) that violates any law, statute ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation; (c) on behalf of any merchant or manufacturer, or for which you were compensated or granted any consideration by any third party; (d) that includes any information that references other apps, addresses, email addresses, contact information or phone numbers; (e) or that contains any computer viruses, worms or other potentially damaging computer programs or files.

Use of Personal Information

1. By entering the Contest, You agree:
   
   1.1. To the use of your name and/or likeness, without compensation, for Sony’s promotional and marketing purposes; and
   1.2. To the use of the information submitted on the Contest entry form, without compensation, for Sony’s promotional and marketing purposes; and
   
   
2. Each individual participating to this Contest acknowledges that:
   In respect of any personal information disclosed by her/him to Sony or obtained by Sony from her/him pursuant to this application:
   
   2.1. She/he is authorised to disclose such personal information;
   2.2. Such disclosure complies with any privacy legislation from any country, within the geographical scope of this competition, and the use of such personal information by Sony as contemplated by this App (including, without limitation, the disclosure of such personal information to Sony's external agencies or third parties)
   
   
3. Sony and its affiliated companies respect the privacy of every individual who visits our App or responds to our advertisements and Contest. Please refer to our Privacy Statement for details.

Disclaimer
Please be advised that all materials posted on the App are subject to public downloading by third party viewers. Sony has taken precautionary steps to deter users from downloading. However, should downloading persist, Sony shall not be held accountable or liable for any damages caused.

Privacy Policy

1. Information - When using the App, you may be asked to enter information, including personal information (“Information”). The Information will only be used for the purposes explained when you have been asked to enter the Information and/or in accordance with this Privacy Policy.
   
   
2. Provision of Information to Third Parties - We will not sell or otherwise transfer the Information to unaffiliated third parties without your approval. If applicable, You will have the opportunity to indicate whether You would like to "opt in" to receiving promotional and/or marketing information about other products, services and offerings from Us and/or any third parties.
   
   
3. Analysis of User Behaviour - We reserve the right to perform statistical analyses of user behaviour and characteristics in order to measure interest in and use of the various areas of the App and to inform advertisers of such information as well as the number of users that have been exposed to or clicked on their advertising banners. We will provide only aggregated data from these analyses to third parties. We are not responsible for any actions or policies of any third parties who request personal information and You should check the applicable privacy policy of that party.
   
   
4. Cookies - You should be aware that information and data may be automatically collected through the use of "cookies". "Cookies" are small text files a app can use to recognise repeat users and allow Us to observe behaviour and compile aggregate data in order to improve the App and to target its advertising. Cookies do not attach to Your system and do not damage Your files. If You do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows You to deny or accept the cookie feature.
   
   
5. Updating or Removing Information - You may notify Us of any updates, amendments and corrections to previously collected Information by using the Feedback Form on the App. Further, upon Your request, We will use commercially reasonable efforts to delete Your Information from our database (but in any event such deletion will be carried out within ten (10) business days). However, it may be impossible to delete Your entry without some residual information because of backups and records of deletions.
   
   
6. Changes to this Policy - We reserve the right, at any time, to modify, alter, or update this privacy policy and any changes shall be notified to You.
