Contest Terms and Conditions

Sony Electronics (Singapore) Pte. Ltd., through its division company Sony South East Asia ("Sony") maintains this website (“Site”) and is responsible for this “'BRAVIA - Your Ideal TV Inch Size' Contest” (“Contest”).

Sony reserves the right to cancel or amend the Contest and the terms and conditions of this Contest (“Terms and Conditions”) at any time without prior notice. Any changes may be posted on the Site.

Please read these Terms and Conditions carefully before accessing and browsing this Site and joining the Contest. By accessing or browsing this Site or joining the Contest, you agree to be bound by these Terms and Conditions.

Qualifying Entrants

  1. The Contest is open only to those who become fans of “Sony Singapore”, "Sony Malaysia", "Sony Thai", "Sony Indonesia", "Sony Philippines" & "Sony Vietnam" on the Facebook pages. Participants below the age of 18 years old as at the date of participation must obtain parental and/or guardian consent before participating.

  2. You warrant to indemnify Sony against any and all claims in relation to your participation of this Contest and breach of its Terms and Conditions contained herein. Sony’s rights are hereby expressly reserved.

  3. Employees of Sony and its affiliates, advertising and promotion agencies of Sony together with their employees, and immediate family members and/or those living in the same household of each of the aforesaid persons are not eligible to participate in this Contest.

  4. Sony reserves the right to disqualify and/or exclude any entries from the Contest, for any reason and for no reason, including without limitation, violation of any portion of these Terms and Conditions.

Contest Rules

  1. The Contest is valid from 17 February to 29 February 2020, 2359hrs (SGT) (“Contest Entry Period”)

  2. All entries must be received by the timing as stated in the individual posts.

  3. In each of the Participating Countries, five (5) comments will be selected by the Panel as the winning entry.

  4. By submitting the Contest entries, you thereby (a) specifically authorizes Sony to use and/or have third parties to use such entry in whole or in part, throughout the world, in perpetuity in or on any and all media, now known or hereafter devised, and alone or together or as part of other information, content and/or material of any kind or nature for the marketing purpose; (b) represents and warrants that all elements contained in the Contest entries (i) is original to you or fully cleared for use as contemplated herein, (ii) does and will not, in any way, violate or breach any of the terms of any other agreement you may be a party to, (iii) is not unlawful information, infringes or violates any copyright or other right (including the image rights), (iv) does not contain libelous, tortuous, or the publication or sale of which will violate any federal or state statute or regulation, (iv) is not obscene or in any other manner unlawful, and (v) shall not require Sony to pay or incur any sums to any person or entity as a result of Sony's use or exploitation of the same.

  5. Representatives of Sony will pick five (5) winners for each Participating Country with the most creative responses (each a “Winner”, collectively “Winners”), all of which shall be at Sony’s sole discretion.

  6. When Sony picks the winner, Sony will contact each of the winner by Facebook private messaging, and request their name, addresses, contact information, such as phone/mobile number (“Contact Information”) for the purpose of disseminating the Prizes (hereinafter defined) of the Contest, and Sony may disclose such Contact Information to a third-party service provider solely for such purpose. The Winners shall agree on providing such Contact Information to receive the Prizes and provide such Contact Information by the date which Sony separately specifies. If any Winner does not agree to provide such Contact Information by such date, such winner will be disqualified and Sony, at its sole discretion, may decide whether a replacement should be selected based on the same criteria as the original one.

  7. Announcement of the winner will be posted as a comment of the contest post at the Facebook page by 13 March 2020.

  8. The winner may be requested to participate in public relations events tied to the contest to generate press coverage of the contest and the accessories range. This may include, but not be limited to, quotes given for inclusion in press releases and press conferences, interviews, etc.

  9. Sony reserves the right to disqualify any entries that do not meet the rules and regulations of the Contest as described in these Terms and Conditions. These include entries submitted with invalid or incorrect information.

Prizes

  1. There will be five (5) winners from each Participating Country.

  2. Each winner of the Contest will win a multi-purpose blanket cushion ("Prize").

  3. Prizes are non-transferable and non-exchangeable for cash and may be subject to availability. Sony reserves the right to replace any prizes with items of similar value without prior notice.

  4. Sony’s decision regarding the Winners, award of all prizes, and/or in every situation including any not covered in these Terms and Conditions, shall be final and binding on all participants in the Contest, and no queries, themes or appeals may be made or entertained regarding Sony’s decision on the same. The receipt by any Winner of any prize under this Contest is conditional upon compliance with any and all applicable laws, rules and regulations.

  5. The Winners shall be responsible to and bear any applicable tax in connection with the prizes. If any tax is applicable to the prize and such tax is (i) required to be withheld by Sony and (ii) permitted to be withheld from the payment under any applicable tax convention, the amount of such tax shall be deducted from the prize by Sony.

  6. Acceptance of any prize shall constitute consent on the Winner's part to allow the use of the Winner's name, image, voice and/or likeness by Sony for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law.

  7. Further, acceptance of any prize shall constitute a release and discharge of Sony by each Winner from any and all liability, claims, demands, causes of action, and/or damages which the Winner may have, whether known or unknown at the present time, of any nature whatsoever, arising out of or relating to: (i) the Contest, (ii) personal injury and/or property damage, theft or loss suffered by the Winner as a result of the use and/or enjoyment of the Prize, and/or (iii) any tax liabilities in relation to the Contest, Prize and/or use or enjoyment of the same.

Privacy Policy

  1. Unless otherwise expressly provided herein, Sony’s current privacy policy also applies to your personal information provided under these Terms and Conditions. Our current privacy policy is located at http://www.sony-asia.com/section/privacypolicy.
  2. Each individual participating in this Contest acknowledges that in respect of any personal information disclosed by her/him to Sony or obtained by Sony from her/him pursuant to the Site:
  1.     She/he is authorized to disclose such personal information; and
  2.     Such disclosure complies with any privacy legislation from any country, within the geographical scope of the Contest, and the use of such personal information by Sony as contemplated by the Site (including, without limitation, the disclosure of such personal information to Sony's external agencies or third parties).

EXCLUSION OF WARRANTY
You expressly acknowledge and agree that use of the Prizes is at your sole risk. EXCEPT OTHERWISE EXPRESSLY PROVIDED HEREIN OR EXCEPT FOR THE WARRANTY FOR THE PRIZES EXPRESSLY PROVIDED BY SONY IN ACCORDANCE WITH ITS APPLICABLE WARRANTY POLICY OR PROVIDED PURSUANG TO ANY APPLICABLE LAW, THE PRIZES ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND AND SONY, SONY'S AFFILIATES (IN THIS SECTION, SONY, AND ITS AFFILIATES SHALL BE COLLECTIVELY REFERRED TO AS "SONY") EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE IN CONNECTION WITH THE CONTEST, THE PRIZES AND/OR THE USE OF THE PRIZES, AND/OR THE WEBSITE AND/OR THE USE OF THE WEBSITE INCLUDING THE MATERIALS THEREON. SONY DOES NOT WARRANT THAT THE FUNCTIONS OF THE PRIZES WILL MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE SOFTWARE INCLUDED IN THE PRIZES WILL BE ERROR FREE. SONY DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE PRIZES IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY SONY SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS LIMITED WARRANTY. SHOULD THE PRIZES PROVE DEFECTIVE YOU (AND NOT SONY) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. THE EXCLUSION OF WARRANTIES ABOVE APPLIES TO YOU TO THE MAXIMUM EXTENT PERMITTED UNDER THE APPLICABLE LAWS AND REGULATIONS AND SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

Liabilities 

  1. Sony cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any participant entering the Contest or as a result of entering the Contest or accepting any prize. Sony is not responsible for any safe custody, return, non-delivery or missing of entries, late, misdirected, problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any app, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Contest.

  2. By entering the Contest or accepting the prizes, participant agrees that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against Sony, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from the Contest and acceptance of any prize, including without limitation, personal injuries, death and property damage.

Disclaimer
Please be advised that all materials posted on the Site are subject to public viewing and downloading by third party viewers. Sony has taken precautionary steps to deter users from downloading. However, should downloading persist, Sony shall not be held accountable or liable for any damages caused.

Miscellaneous

  1. Sony reserves the right, in its sole discretion, to terminate or suspend this Contest without any liability to anyone should there be unforeseeable events which in Sony’s absolute opinion may jeopardize the process of the Contest.

  2. In the event of disputes regarding the Contest or the Terms and Conditions of the Contest, Sony shall have the right to make the final decision.

  3. The Terms and Conditions of this Contest shall be governed by and construed in accordance with the laws of the Republic of Singapore and subject to the exclusive venue of the courts sitting in Singapore, and the parties hereby consent to the venue and jurisdiction of such courts.
